1. NAME
The name of the association
shall be the Police Surfing Association. The Club will be-
(a) registered under the NSW
Association Incorporation act of 1999 and will operate in accordance
with the relevant provisions of that Act and its regulations and
(b) shall affiliate with the NSW Police Council of Sport incorporated.
2. OBJECTIVES
The objectives of the organization
shall be-
(a) To encourage, foster and oversee
sporting competitions amongst members or teams from within the
New South Wales Police, or to compete with or against other external
organizations
(b) To Foster surfing within the NSW Police.
3. MEMBERSHIP QUALIFICATIONS
A person is qualified to be
a member of the association if they are a current serving or retired
member of the NSW Police, family or nominated friend.
The committee will determine who is suitable to be a nominated friend
upon application of members.
4. FEES AND SUBSCRIPTIONS
Annual subscriptions and a
competitive fee will be decided at each annual general meeting by
consideration of the recommendation made by the outgoing committee.
5. CESSATION OF MEMBERSHIP
A person ceases to be a member
of the association if the person:
(a) dies, or
(b) resigns membership, or
(c) is expelled from the association
6. MEMBERSHIP ENTITLEMENTS NOT
TRANSFERABLE
A right, privilege or obligation
which a person has by reason of being a member of the association:
(a) is not capable of being transferred
or transmitted to another person, and
(b) terminates on cessation of the person's membership
7. REGISTER OF MEMBERS
(1) The public officer
of the association must establish and maintain a register of members
of the association specifying the name and address of each person
who is a member of the association together with the date on which
the person became a member.
(2) The register of members
must be kept at the principal place of administration of the association
and must be open for inspection, free of charge, by any member of
the association at any reasonable hour.
8. MEMBERS' LIABILITIES
The liability of a member
of the association to contribute towards the payment of the debts
and liabilities of the association or the costs, charges and expenses
of the winding up of the association is limited to the amount, if
any, unpaid by the member in respect of membership of the association.
9. CONDUCT OF MEMBERS
The management committee may
suspend or expel any member who violates
(a) the rules and regulations
of the association
(b) any resolution of the committee or
(c) is guilty of misconduct, after asking the member to appear
before the committee to explain or defend his/her action. Any
members so disciplined may give notice of appeal against the penalty
imposed, within seven (7) days of advice thereof.
(d) Such appeal must be in writing and shall be dealt with by
a Judiciary consisting of any three members. The Judiciary after
due investigation and consideration shall confirm or vary the
original penalty and their decision shall be final.
10. THE COMMITTEE POWERS OF THE
COMMITTEE
The committee is to be called
the committee of management of the association and, subject to the
Act, the Regulation and these rules and to any resolution passed
by the association in the general meeting:
(a) Is to control and manage the
affairs of the association, and
(b) May exercise all such functions as may be exercised by the
association, other than those functions that are required by these
rules to be exercised by a general meeting of members of the association,
and
(c) Has power to perform all such acts and do all such things
as appear to the committee to be necessary or desirable for the
proper management of the affairs of the association.
(d) Will accept or reject member's nominations for the inclusion
of nominated friends as members of the PSA.
(e) Determine what are to be classified as national and international
events for the PSA calendar
(f) The committee will make the decision on the Selection of members
to attend national and international events when numbers are limited.
(g) Funding for national and international events- The committee
will determine who will be selected and the amount of funding
to be provided to members for sanctioned national and international
events.
(h) The following will be taken into consideration when determining
the amount of funding for members attending sanctioned events-
1. Current membership of PSA
2. Current membership of the NSW Police Council of Sports
3. Results of competitions
4. Attendance at PSA events
5. PSA involvement (Fundraising activities, organization and
assistance to PSA)
12. ANNUAL ELECTION OF OFFICERS
Election of officials shall
take place at the annual general meeting
(a) Nominations for positions
shall be in writing and lodged with the Secretary prior to the
commencement of the meeting. Serving and retired Police are only
entitled to take up positions on the committee. The nominations
shall be made by a proposer and seconder, both being financial
members of the PSA and endorsed by the nominee
(b) If sufficient written nominations are received to fill an
available position the candidate shall be deemed to be elected
and further nominations shall be called and received from the
floor at the meeting
(c) Only financial members that are serving or retired police
present at the |AGM and or special meetings are entitled to vote.
13. DUTIES OF OFFICE BEARERS
Officer bears of the association
and committee members shall, subject to the association rules, hold
office until all positions are declared vacant at the next general
meeting. |All officer bearers are eligible for re-election.
The President is the chief
executive office and shall preside at all general and management
meetings of the club. The President shall carry out or cause to
be carried out all services and operation of the association in
accordance with the resolutions of the management committee and
general meetings. The president, in the case of equality of voting,
has a second or casting vote.
The Secretary and Public Officer
shall take the minutes of the proceedings of the executive, management
and general meetings which shall be authenticated by the chairman
on their confirmation at the subsequent meeting. As soon as practicable
the secretary shall post a copy of the minutes of each management
meeting on the Bulletin |Board, and shall effect the execution of
all correspondence of the club and keep a register of all members.
As public Officer the duties include the compliance with all the
requirements of the Associations Incorporations Act, 1999 in so
far as it affects the Association.
The Treasurer shall have
control of the accounts of the association and will ensure that
all the money due is collected and received and that all payments
by the association are made, at each management meeting the office
bearer shall table details of receipts and expenditure and assets
and liabilities of the association. At the completion of the financial
year cause a statement of income and expenditure, assets and liabilities
of the association. At completion of the financial year cause statement
of income and expenditure together with a balance sheet to be prepared
and arrange an audit of the same for presentation to the annual
general meeting of members. All moneys received by the treasurer
shall be banked in the name of the association. All payments shall
be made by cheque and signed by the treasurer after accounts have
been passed by a management meeting and recorded in the minutes.
The Captain shall have full
charge of members of competition and general discipline, and ensure
that all competitions are carried out in accordance with association
rules.
Auditor, who may not be a
member of the association, shall be appointed by the committee and
shall have access to all books, accounts, vouchers and property
of the association and should examine them for correctness at the
conclusion of each financial year
Delegates to the NSW Police Service,
Council of Sports, are to appointed by the committee.
14. GENERAL MEETINGS
The annual General Meeting
of the association is, subject to the act, to be convened on such
a date and at such a place as the committee thinks fit.
In addition to any other business
which may be transacted at an annual general meeting, the business
of annual general meeting is to include the following-
(a) to confirm the minutes of
the last preceding annual general meeting and of any special general
meeting held since that meeting,
(b) to received from the committee reports on the activities of
the association during the preceding financial year
(c) to elect office-bearers if the association and ordinary members
of the committee, An annual general meeting must be specified
as such and notice convening it.
15. INSURANCE
The association must effect
and maintain insurance under section 44 of the act.
16. FUNDS
Source The funds of the association
are to be derived from entrance fees annual membership fee's, donations
and fundraising activities including raffles, dinners and any other
sources as the committee determines.
All moneys received by the association
must be deposited as soon as practicable and without deduction to
the associations bank account.
The association must, as soon as
practicable after receiving any moneys issue an appropriate receipt.
Management
Subject to any resolution passed by the association in general meeting,
the funds of the association are to be used in the pursuance of
the objectives of the committee in such a manner as the committee
determines.
17. CUSTODY OF BOOKS
The secretary and the public
officer shall be the custodians of all books, records and documents
of the incorporated association and shall make such books, records
and documents available for inspection by a financial member of
the association given reasonable notice.
18. AMENDMENTS OF CONSTITUTION
No alteration or amendment
of this constitution shall be made except by a resolution at a general
meeting. The amendment motion must be carried by a three quarter
majority of the members present and entitles to vote. An updated
copy of the constitution is to be displayed on the bulletin board
or other facility.
19. ASSOCIATION RULES
Association rules are resolutions
passed at general meetings or at management meetings, which are
carried on from year to year. Rules already in existence should
be endorsed at the Annual General Meeting.
20. DISSOLUTION
The association shall be dissolved
in the vent of the membership being less than three persons, or
upon the vote of a three fourths majority of the members present
at a special general meeting convened to consider such a proposal.
Upon dissolution, the assets and funds of the association may after
payment of all expenses and liabilities be utilised for a final
association function or given to a charity determined by the majority
of members present at the general meeting of the association.
